Documenting Documents – An Explanation of Forms

An effective document-management process should be secure, efficient, and compliant. This workshop will review many of the key documents used by dealerships, including retail installment sale contracts, buyer’s orders, and ancillary forms. I will discuss liabilities if forms are not properly drafted, provide tips for document creation and review, review common mistakes dealers make using customized forms, and explain the benefits of a compliance management process. This session will strengthen F&I forms procedures and help your dealership prepare to transition to electronic forms. Finally, I will give insight on governmental audits, legal discovery, and avoiding litigation, based on my experience with the Florida Attorney General’s Office.

Session Objectives:
1. Create an audit checklist that summarizes the key forms needed to complete an F&I transaction and assess whether those forms have compliance risks.
2. Know the steps a state attorney general will take to review F&I forms and processes.
3. Have the tools to return to their dealerships and begin implementing an F&I program that helps them discharge their compliance responsibilities.

Layered Risks: What makes a subprime loan risky?
Is credit score alone enough to make a prudent decision on loan originations? What other factors are most important in evaluating credit risk? In this session, Moody’s Analytics Auto Economist Michael Vogan will take a deep dive into subprime loan performance and what factors put a borrower at higher risk of default. Using loan performance data from Moody’s CreditForecast.com database, attendees can expect to learn about where the market stands today, what the future holds and what additional factors they should consider when making origination and risk management decisions.

There are three main objectives to this session:
1. Explain why a subprime credit score by itself does not necessarily mean a higher risk of default and elaborate on what factors in combination with a low credit score (low income, term length, geography, etc.) leads to reduced creditworthiness.

2. Explain why there is no “bubble” in subprime auto credit and give an overview of the current state of the subprime credit market. Despite not being in a bubble, some lenders are more exposed than others based on factors such as institution type and underwriting policy and the presentation will address where those risks lie. The breakdown will include the various layers of risk including current geographic concentrations, income specific risks and risks associated with term length.

3. Subprime default rates have been increasing over the past four years but that trend will not continue past this year. The session will provide a forward looking view of both subprime origination volumes as well as default and expected loss rates to help attendees assess what the market will look like at this time next year and beyond.
